OVERVIEW

This website is operated by Pegah Watson ("Pegah Watson," "we," "us," or "our"). These Terms of Service ("Terms")

govern your use of our website and your purchase of merchandise or services from Pegah Watson.

By accessing our website, placing an order, or purchasing from us, you agree to these Terms and any policies referenced

on the website, including our Shipping Policy and Privacy Policy.

If you do not agree to these Terms, please do not use the website or purchase from us.

1. VINTAGE, PRE-OWNED, AND ONE-OF-A-KIND MERCHANDISE

Unless expressly stated otherwise, vintage and pre-owned merchandise is sold as-is and with all faults, subject to any

rights that cannot legally be waived.

Vintage and pre-owned merchandise is not new and should not be expected to be in new or perfect condition.

Items may exhibit characteristics consistent with age and prior use, including patina, scratches, marks, fading,

discoloration, oxidation, finish variations, wear, previous repairs, restoration, refinishing, replaced components, and other

imperfections.

These characteristics are inherent to vintage and pre-owned merchandise and are not necessarily considered defects.

Pegah Watson makes reasonable efforts to accurately photograph and describe each item. However, photographs and

descriptions may not reveal every imperfection, repair, restoration, variation, or characteristic.

Customers are encouraged to request additional photographs, measurements, condition information, or other details

before purchasing.

2. PRODUCT INFORMATION, PHOTOGRAPHY, COLOR, AND MATERIAL VARIATIONS

We make reasonable efforts to accurately display and describe our merchandise.

Colors, finishes, textures, materials, grain, veining, patina, and other characteristics may appear differently depending on

lighting, photography, screens, devices, and viewing conditions.

Natural materials, handmade products, restored pieces, vintage materials, wood, stone, leather, metal, cork, veneer,

fabric, and other materials may naturally vary from piece to piece.

Such reasonable variations are not considered defects.

3. MEASUREMENTS AND FIT

All measurements are approximate unless expressly stated otherwise.

The customer is responsible for confirming that an item will fit its intended location and can safely pass through all

necessary doorways, hallways, stairways, elevators, gates, loading areas, and other access points.

Pegah Watson is not responsible if merchandise does not fit through a customer's building, residence, doorway, elevator,

stairway, or intended installation location.

Failure to properly measure does not provide a basis for cancellation, return, exchange, or refund.

 

4. DESIGNER, MANUFACTURER, ATTRIBUTION, AND PROVENANCE

Pegah Watson makes reasonable efforts to identify the designer, manufacturer, period, origin, materials, and provenance

of vintage merchandise.

Because vintage merchandise may lack original labels, receipts, documentation, or other identifying information, some

descriptions may reflect a good-faith assessment based on the information reasonably available to us.

Terms such as "attributed to," "in the style of," "in the manner of," "possibly by," "after," or similar language indicate an

attribution or opinion and are not a guarantee of authorship, manufacturer, origin, or provenance.

Customers purchasing an item primarily because of its attribution, designer, manufacturer, provenance, or historical

significance are encouraged to request available documentation or obtain independent expert verification before

purchasing.

5. RESTORATION, REFINISHING, RE-VENEERING, AND REPURPOSING

Vintage merchandise may have been restored, refinished, repaired, reupholstered, rewired, re-veneered, repurposed,

reimagined, modified, or otherwise altered from its original condition during its lifetime or by Pegah Watson.

Our restoration and design process may include refinishing or replacing existing surfaces; applying new wood, burl, cork,

laminate, or other veneers and materials; reupholstering; replacing cushions or foam; repairing or replacing hardware,

wiring, structural components, fasteners, or other materials; and making other aesthetic or functional modifications.

Certain vintage pieces may be reimagined or repurposed using new materials, finishes, veneers, colors, hardware, or

other design elements while retaining all or part of the original vintage structure or form.

Unless expressly stated otherwise, Pegah Watson does not represent that every component, material, finish, veneer,

upholstery, hardware element, or other part of a vintage item is original.

Where reasonably known, significant restoration, re-veneering, refinishing, or modification performed by Pegah Watson

will be described in the product listing.

We may use independent restorers, upholsterers, woodworkers, veneer specialists, fabricators, craftspeople, and other

qualified service providers in connection with restoration, modification, or custom work.

6. VINTAGE LIGHTING AND ELECTRICAL ITEMS

Vintage lighting and electrical items may contain original, replaced, repaired, rewired, or modified electrical components.

Unless expressly stated otherwise, Pegah Watson does not represent that vintage wiring, sockets, switches, plugs,

fixtures, or other electrical components comply with current electrical or building codes in the customer's jurisdiction.

Vintage electrical items should be inspected and, where appropriate, installed or rewired by a qualified professional before

use.

The customer is responsible for determining and complying with applicable electrical and installation requirements.

7. ORDERS, PRICING, AND AVAILABILITY

All prices are listed in U.S. dollars unless otherwise stated.

Prices, descriptions, and availability may change without notice.

Many Pegah Watson pieces are one-of-a-kind and may simultaneously be offered through our showroom, website, social

media, marketplaces, or other sales channels.

An item placed in a shopping cart is not reserved until the order has been accepted and payment successfully processed.

We reserve the right to refuse, limit, modify, or cancel an order because of product unavailability, pricing or description

errors, payment issues, suspected fraud, shipping limitations, or other legitimate business reasons.

If Pegah Watson cancels an order after receiving payment, amounts paid for the canceled merchandise will be refunded

as required by applicable law.

8. PAYMENT

Customers agree to provide accurate and authorized payment information.

Unless otherwise agreed in writing, merchandise must be paid in full before it is released, picked up, shipped, or delivered.

Applicable taxes, shipping, delivery, storage, and other agreed charges are the customer's responsibility.

Custom and made-to-order merchandise is subject to the payment terms below.

9. CUSTOM AND MADE-TO-ORDER PRODUCTS

All custom, commissioned, modified, resized, specially fabricated, and made-to-order merchandise is final sale.

A 50% non-refundable deposit is required to confirm the order and begin production.

The remaining 50% balance is due upon completion and must be paid in full before the merchandise is released, picked

up, shipped, or delivered.

Production begins after the required deposit and necessary specifications, dimensions, drawings, materials, fabrics,

finishes, colors, or other approvals have been confirmed.

Estimated production and completion dates are estimates and are not guarantees. Delays may occur because of material

availability, fabrication, craftsmanship, restoration, suppliers, transportation, or circumstances outside our reasonable

control.

Customer-requested changes after approval may result in additional charges and extended lead times. Pegah Watson

may decline requested changes once production has begun.

Handmade and custom merchandise may exhibit reasonable variations in color, grain, texture, finish, dimensions, or

craftsmanship. Such variations are inherent to handmade production and are not considered defects.

Once the 50% deposit has been paid and the order confirmed, the order may not be canceled, returned, or exchanged.

10. ALL SALES FINAL - NO RETURNS OR EXCHANGES

All sales are final.

All merchandise sold by Pegah Watson is final sale, including vintage, pre-owned, one-of-a-kind, restored, refinished,

re-veneered, repurposed, reimagined, custom, commissioned, made-to-order, special-order, and specially sourced

merchandise.

We do not accept returns or exchanges and do not provide refunds for change of mind, buyer's remorse, color or

appearance differences, size or fit, access problems, inability to fit merchandise into a residence or building, or other

reasons unrelated to a seller error or a right that cannot legally be waived.

Customers are responsible for carefully reviewing photographs, descriptions, measurements, condition information,

materials, finishes, and shipping information before purchasing.

Please ask all questions and request any additional photographs, measurements, or information you require before

completing your purchase.

Nothing in these Terms limits any consumer right that cannot legally be waived under applicable law.

11. SHIPPING AND DELIVERY

Unless expressly stated otherwise, shipping and delivery are not included in the purchase price and are the responsibility

of the customer.

Shipping and delivery dates are estimates and are not guaranteed.

Independent shipping and delivery providers are separate third-party service providers.

Customers must provide complete and accurate delivery information and disclose special delivery circumstances before

shipment, including stairs, elevators, loading docks, restricted access, building requirements, delivery windows, or other

unusual conditions.

Additional charges resulting from inaccurate information, missed deliveries, refused deliveries, redelivery, unusual access

conditions, or customer-requested changes are the customer's responsibility to the extent permitted by law.

12. BUYER-ARRANGED SHIPPING

If the customer selects or independently hires a carrier, shipper, freight company, mover, courier, or other transportation

provider, that provider acts on behalf of the customer.

The customer is responsible for selecting the carrier and determining whether appropriate packing, handling, and

insurance are provided.

Risk associated with buyer-arranged transportation transfers as permitted by applicable law once the merchandise has

been released to the carrier selected by the customer.

13. INSPECTION AND SHIPPING DAMAGE

Customers should inspect merchandise promptly upon delivery.

Any visible shipping damage should be photographed immediately and, where applicable, noted on the carrier's delivery

documentation before the carrier leaves.

Customers should retain packaging and photograph the merchandise, packaging, and damage.

Shipping damage is handled separately from our Final Sale policy and may be subject to the requirements and claim

procedures of the applicable carrier or insurer.

Do not discard packaging, repair, refinish, modify, or alter damaged merchandise before a shipping claim has been

evaluated, as doing so may affect the claim.

14. LOCAL PICKUP, COMPLETED ORDERS, AND STORAGE

Customers selecting local pickup are responsible for arranging appropriate transportation, personnel, equipment,

protective materials, and loading assistance as agreed.

Completed merchandise must be picked up or scheduled for delivery within the timeframe communicated by Pegah

Watson.

If merchandise is not picked up, shipped, or accepted within a reasonable period after the customer has been notified that

it is available, Pegah Watson may charge reasonable storage fees if those fees and their effective date have been

disclosed to the customer.

Any outstanding merchandise balance, shipping, delivery, and applicable storage charges must be paid before

merchandise is released.

15. INSTALLATION AND USE

Unless installation is expressly included in writing, the customer is responsible for proper installation, mounting, assembly,

anchoring, electrical connection, and use of merchandise.

Where professional installation is appropriate, the customer should use a qualified professional.

Pegah Watson is not responsible for damage resulting from improper installation, mounting, assembly, modification,

misuse, or failure to follow appropriate professional installation practices, to the extent permitted by law.

Customers are responsible for applicable sales taxes, use taxes, customs duties, import charges, brokerage fees, or other

governmental charges unless expressly stated otherwise.

International customers are responsible for determining applicable import restrictions, customs requirements, duties,

taxes, and other requirements in their destination country.

17. PHOTOGRAPHS, IMAGES, AND INTELLECTUAL PROPERTY

All photographs, product images, styled interior images, videos, graphics, text, product descriptions, logos, branding,

website content, and other original materials owned by Pegah Watson are protected by applicable copyright and

intellectual property laws. All rights are reserved.

Purchasing merchandise from Pegah Watson does not transfer copyright or ownership rights in any Pegah Watson

photograph, image, design, text, or other protected material.

PERMITTED SHARING

Pegah Watson images may be saved or shared on Pinterest for personal, non-commercial inspiration purposes, provided

that Pegah Watson is identified as the source and, where reasonably practical, the image links back to the original Pegah

Watson website or product page.

Interior designers, interior decorators, architects, and other design professionals may use Pegah Watson product images

in private client presentations, mood boards, design proposals, and sourcing presentations for the purpose of specifying,

recommending, or sourcing the actual product from Pegah Watson.

Where reasonably practical, Pegah Watson should be identified as the source.

These permissions do not transfer copyright or ownership of the photograph.

PROHIBITED COMMERCIAL USE AND KNOCKOFFS

Pegah Watson photographs and images may not be used to manufacture, reproduce, copy, advertise, market, offer for

sale, or sell a replica, reproduction, imitation, knockoff, counterfeit, or other unauthorized product based upon or

represented by the product shown in a Pegah Watson photograph.

Without prior written permission, Pegah Watson photographs may not be used in product listings, advertisements,

catalogs, or commercial sales materials on Alibaba, AliExpress, Amazon, eBay, Etsy, or any other marketplace, wholesale

platform, manufacturer or factory website, dealer website, retailer website, auction platform, or commercial sales platform.

Manufacturers, factories, wholesalers, dealers, retailers, resellers, and other commercial sellers may not use Pegah

Watson photographs to advertise or sell another party's merchandise; advertise or sell a copy, replica, reproduction,

imitation, counterfeit, or knockoff; represent another product as the product appearing in our photograph; represent Pegah

Watson merchandise as their own inventory; solicit manufacturing orders or inquiries; create commercial product listings;

falsely suggest that Pegah Watson designed, manufactured, supplied, authorized, endorsed, or is affiliated with another

party's merchandise; or remove or obscure Pegah Watson watermarks, attribution, copyright notices, or other identifying

information.

Permission to share an image on Pinterest or use it in a private professional design presentation does not grant

permission to commercially exploit the photograph or manufacture, advertise, market, or sell another product using that

photograph.

Unauthorized use may constitute copyright infringement or violate other applicable intellectual property laws. Pegah

Watson reserves all rights and remedies available under applicable law.

Nothing in this section restricts uses that cannot legally be prohibited under applicable law.

18. PROHIBITED WEBSITE USE

Users may not use the website or its content for unlawful, fraudulent, misleading, infringing, or unauthorized purposes.

Without authorization, users may not scrape, systematically download, harvest, reproduce, duplicate, copy, sell, resell,

commercially exploit, or create unauthorized derivative uses of website content.

Users may not interfere with website security, transmit malicious software, impersonate another person or business,

submit fraudulent information, or use the website in a manner that violates the rights of Pegah Watson or another party.

19. THIRD-PARTY SERVICES AND LINKS

Our website may use or link to third-party services, including payment processors, shipping providers, social-media

platforms, and other service providers.

Third-party services are governed by their own terms and policies. Pegah Watson is not responsible for the operation or

content of independent third-party websites or services except to the extent required by applicable law.

20. PRIVACY

Personal information collected through the website is handled in accordance with our Privacy Policy and applicable law.

21. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the website is provided on an "as-is" and "as-available" basis.

Vintage and pre-owned merchandise is sold as described and photographed and may exhibit age, wear, patina,

restoration, repairs, variations, and other characteristics described in these Terms.

Except for warranties expressly provided by Pegah Watson or warranties that cannot legally be excluded, we disclaim

implied warranties to the maximum extent permitted by applicable law.

22. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Pegah Watson will not be liable for indirect, incidental, special,

exemplary, punitive, or consequential damages arising from use of the website, purchase or use of merchandise, or

services provided in connection with a transaction.

To the fullest extent permitted by applicable law, Pegah Watson's aggregate liability relating to a particular product or

transaction will not exceed the amount actually paid to Pegah Watson for the product or service giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

23. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold Pegah Watson harmless from third-party

claims arising from your unlawful use of the website, violation of these Terms, infringement of another person's rights, or

unauthorized use of Pegah Watson intellectual property.

24. FORCE MAJEURE

Pegah Watson will not be responsible for delays or failure to perform caused by circumstances reasonably outside our

control, including transportation disruptions, carrier delays, supplier delays, material shortages, labor disruptions, natural

disasters, fires, severe weather, governmental actions, or other events beyond our reasonable control.

Nothing in this section limits rights that cannot legally be waived.

25. ERRORS AND CORRECTIONS

We reserve the right to correct typographical errors, inaccuracies, omissions, pricing errors, product-description errors,

shipping errors, or availability information on the website.

If a material error affects an order, we may contact the customer to correct the order or cancel the affected transaction and

issue any refund required by applicable law.

26. GOVERNING LAW

These Terms and transactions with Pegah Watson are governed by the laws of the State of California, without regard to

conflict-of-law principles, except where applicable law requires otherwise.

Any legal proceeding that is not otherwise required by law to be brought elsewhere shall be brought in a court of

competent jurisdiction in California.

27. CHANGES TO THESE TERMS

We may update these Terms from time to time.

The current version will be posted on this website with an updated "Last Updated" date.

Your continued use of the website after changes are posted constitutes acceptance of the revised Terms to the extent

permitted by applicable law.

28. SEVERABILITY, WAIVER, AND ENTIRE AGREEMENT

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be modified or limited to the

minimum extent necessary, and the remaining provisions will remain in effect.

Failure to enforce a provision of these Terms does not waive the right to enforce that provision in the future.

These Terms, together with any policies or terms incorporated by reference, constitute the entire agreement between the

customer and Pegah Watson concerning use of the website and purchases made through it, except where separate

written terms have been agreed to for a particular transaction.
